Data Privacy & Cybersecurity Committee

Mission Statement:

Data privacy and cybersecurity are two areas of growing concern for licensing professionals and legal practitioners. There are a multitude of laws and regulations—state, federal, and international—governing data security and privacy to which our U.S. members’ companies must adhere. Moreover, as a relatively new concern, opportunity exists to shape laws, regulations, and best practices. The DP&C Committee will provide a forum for education, discussion, and networking opportunities for LES private sector and government members interested in these topics. We endeavor to provide and/or facilitate such benefits as:

  • Educational opportunities such as webinars, panel discussions, and roundtables to discuss current topics impacting LES members
  • Analysis of current data privacy provisions in license agreements and legal implications thereof
  • Tracking of proposed laws and regulations and organize community efforts to provide input, as appropriate
  • Development of best practices for drafting, negotiating and interpreting license provisions
  • Strategies for internal organization data privacy and cybersecurity policies and encouraging compliance
  • Easy access to resources (laws, regulations, other written materials) relating to these topics

Educational Aspirations

Our focus will be on topics relevant to US companies that do business both in the US and internationally. The Committee will host 2-4 webinars per year, with some jointly hosted with other committees. Topics under consideration for educational opportunities include:

  • The EU’s General Data Protection Regulation (GDPR), both compliance and risks
  • California Consumer Privacy Act (CCPA)
  • Economics and valuation issues in cybersecurity breaches and data loss
  • The U.S. Government’s Section 813 Panel on technical data rights, restrictions, and regulatory mechanisms
  • NIST’s federal standards, guidelines, recommendations, and research on the security and privacy of information and information systems.
  • Litigation strategies in view of GDPR’s data subject access provisions
  • Data privacy and cybersecurity in the robotics industry
  • The National Association of Insurance Commissioners’ proposed Data Security Model Law and adoption/non-adoption by states

We encourage our members to send us speaker suggestions, topics of interest, and feedback on past webinars, so we can better tailor our content and events to suit our members’ diversified interests.
