An in-house licensing executive and an outside counsel share their perspectives on:

  • Approaches to bioinformatic IP:  method vs marker; diagnostics vs therapeutics
  • How does the bio in bioinformatics make it different to other informatics related IP (i.e. extra complexity and parallel pathways). 
  • How do typical bioinformatic licensing clients ‘present’, and what are their needs? 
  • What types of bioinformatic work goes on ‘behind’ the scenes that is not usually the subject of formal IP, and why not?
  • When does a company feel that bioinformatics will require a licensing agreement?
  • In bioinformatics, should we file early and often? What risks unique to bioinformatics does this present?
  • What are the elements of an effective integrated bioinformatics IP protection strategy?

Stephen Barone, Ph.D., J.D.
, is a partner of Lathrop & Gage LLP and heads the firm’s High Tech Chemical Practice group.  Steve represents start-up companies, top tier academic research institutions and Fortune 500 companies, assisting them in protecting and commercializing their intellectual property.  His practice also includes strategic business planning, due diligence and landscape assessment.  Steve obtained a Ph.D. in Chemistry from University of Colorado, and was an Assistant Professor of Chemistry at The George Washington University prior to completing law school at the University of Colorado School of Law.

Leo McHugh, Ph.D. is currently Director of Bioinformatics at Immunexpress, Inc., a pioneer in the management of sepsis using host response markers to diagnose, predict and monitor the interactions between pathogens and human patients. Leo is author on a range of bioinformatic patents and has been involved in-licensing and licensing-out bioinformatic IP for the previous 10 years in start-ups, not-for profits and pharma. Leo holds degrees in molecular genetics, computational science, innovation management and artificial intelligence, and has applied machine learning and novel algorithmic approaches across a range of sciences including engineering, statistics and computational biology.
