Description:

In many cases, intellectual property (IP) assets are the first assets developed by entrepreneurs and start-up companies.  It is common for entrepreneurs and start-ups to base their business case on the commercialization of a legally-protected innovation that is an improvement on the status quo in the relevant markets.  The value of such IP can sometimes be the engine that allows an early-stage enterprise to take off towards success.  This webinar is meant to introduce LES members to (1) the reasons why emerging enterprises may benefit from valuing their IP and (2) the foundational concepts related to performing IP valuations.  More specifically, we will focus on the use of an IP valuation to secure capital (including for both equity investment and debt financing), and to support IP-based transactions such as licenses, buy/sell transactions, and joint venture formations.  Further, the webinar will provide a high-level introduction to the use of the three traditional valuation approaches – the Income, Market, and Cost approaches.  A short case study will be provided to apply the theoretical valuation concepts to a real-life licensing scenario.

Scott Weingust, Managing Director, Intellectual Property Services, Stout Risius Ross, LLC

 

Scott Weingust is the leader of Stout’s Intellectual Property Valuation practice. Mr. Weingust has 20 years of experience providing consulting services to corporations, law firms, universities, and investment firms primarily in the areas of intellectual property valuation, damages, monetization, and management.   He has been recognized as one of the world’s leading IP strategists as part of the 2017 and 2018 IAM Strategy 300.  Mr. Weingust has provided testimony as a damages and valuation expert in intellectual property-related litigation including having offered opinions in Federal District Court.  He has testified on a variety of dispute matters including those with claims associated with patent infringement, trade secret misappropriation, fraudulent transfer, breach of contract,  and others.  Mr. Weingust has performed due diligence and valued intellectual property and other intangible assets for a variety of purposes including: transactions, tax strategy and compliance, corporate strategic decision-making, use of intellectual property to attract capital, financial reporting, regulatory compliance, and bankruptcy, among others.  He has been directly involved in intellectual property licensing negotiations and has developed many reusable intellectual property pricing/valuation models for corporate licensing activities and investment decisions.  Mr. Weingust is currently an adjunct professor at DePaul University College of Law where he teaches a course on intellectual property valuation.
