Welcome to the High Technology Sector!

Members of this sector include professionals working for companies, research institutions, service providers, and organizations associated with advanced new technologies. In today's world, the traditional delineation between "high tech" as it traditionally related to electronics, software, and systems has blurred. In addition to these traditional industries, high technology now plays key roles in life sciences, agriculture, the chemical and energy industries, and much more. Indeed, this an exciting time to be part of the expanding LES High Technology Sector.

From the HTS Leadership Team

The primary mission of the LES High Technology Sector is ongoing:

  • We provide a forum for education, discussion and networking related to high technology IP management. Our committees include Aerospace & Transportation, Mobile & Consumer Electronics, Clean Tech, Digital Content, Gaming IP & Technology, Nanotechnology, Semiconductor, and Software.
  • HTS members articulate the operational, contractual, legal and political challenges associated with managing technology-centric intellectual property. We collectively seek, find, and share solutions to those problems.
  • HTS shares information on best practices in its Committees' and Special Initiative work within LES.  In addition to open committee calls, we contribute through LES publications, presentations at meetings, and special, educational seminars and webinars.  Our 2011 Royalty Rate Survey will continue to provide valuable data to our members through 2012 and beyond.
  • The High Technology Sector is lighting the path for more effective licensing, and our efforts help facilitate the essential exchange of complex, interdisciplinary advanced technology solutions to the world's most difficult technical challenges and problems.   We hope you will join us along the way!

  • The speaker lineups for this year’s Winter, Spring, and Annual Meetings are the best ever. We hope you will join us at these exciting events.
  • Our Sector has launched new Wire Touch Initiatives to help members connect and communicate with each other.  These special efforts by dedicated members of the HTS Leadership Team will help our committees and members contribute to the HTS mission.
  • We invite you to take advantage of all we have to offer by watching for our monthly newsletter with dates and highlights of the HTS events schedule.  We hope you will tune in, become more active, and take full advantage of all that we have in store for our Sector members.

High Tech Sector Royalty Rate & Deal Terms Survey 

LES (USA & Canada) initiated its first High Tech Sector Royalty Rate & Deal Terms Survey in 2011.

High Tech Survey Respondents

The Survey received responses from 52 companies for the period from 2008 through 2011, with a total of 228 complete deals being submitted.  The following major high technology fields were reported: aerospace, software, clean technology, communication, semiconductor, consumer products and electronics, computer, etc., 76% of which involved patents.

Key Deal Statistics 

86% of respondents were licensors, with more than half of them entering the deal for monetary gain in addition to a strategic relationship. Deals with flat percentage rate royalties were weighted more towards licensees with annual sales revenue <$25M. Deals containing lump sum payments were heavily weighted towards licensees with annual sales revenue >$500M. Almost an equal split between exclusive and non-exclusive deals. Average sales-based flat percentage rate was 6%, but, the average rate within specific industries varied widely.
