U.S. District Judge James Holderman Will Present F/RAND Licensing: A Federal Judge's Perspective

NEW YORK, March 4, 2014—The Licensing Executives Society (U.S.A and Canada), Inc., first-ever Mid-Year Meeting, March 25-27 in New York, will welcome U.S. District Judge James F. Holderman.  He is one of only a handful of federal judges who has been called upon to address the issue of RAND rates in the course of patent litigation.  Judge Holderman is the only federal judge who, to date, has made a RAND determination in the context of a multi-district, multi-party case.  He did so in the fall of 2013 in Innovatio IP Ventures, LLC Patent Litigation, MDL 2303.

Parties to that litigation included manufacturers, Cisco Systems, Inc.; Motorola Solutions, Inc.; Sonic WALL, Inc.; NETGEAR, Inc.; and Hewlett-Packard Co., which had filed declaratory judgment actions when non-practicing entity Innovatio IP Ventures, sued numerous coffee shops, hotels, restaurants, supermarkets, large retailers, transportation companies, and other commercial users of wireless technology located throughout the United States for infringement of 168 patent claims in 23 patents Innovatio obtained from Broadcom. After Judge Holderman's October 3, 2013 RAND determination, many of the parties settled. Although Judge Holderman will not be commenting on any litigation that is pending before him, he is in a unique position to provide a federal judge's perspective on the topic.

"Judge Holderman joins a distinguished group of leading presenters from across the intellectual property, technology and business development industries who will bring enlightened perspectives and lessons learned to inform and assist our attendees in navigating the quickly changing IP landscape," said 2014 Meeting Chair, Kevin Arst, a Partner with 284 Partners, LLC.

Among featured presenters will be executives from ARM, Ltd., BASF, Bigelow Laboratory for Ocean Sciences, Bose, Cornell, GE, GlaxoSmithKline, GAO, Harvard, Hong Kong Trade Development Council, IBM, Johnson & Johnson, Pfizer, Microsoft, NIH, Qualcomm, Verizon and others.

The meeting, themed 'Advancing and Enhancing Business Development, Deals & Innovation,' will draw top IP business executives, licensing leaders, VCs, and entrepreneurs, as well as representatives from government, federal and national labs, universities and others organizations for programming that is customized to deliver timely and compelling information, best practices, perspective and usable tools specifically suited to each attendee's industry sector and professional needs. The meeting will also offer rare opportunities for collaboration and information exchange among industry leaders, as well as extensive networking across industries.

Interactive workshops and roundtables will cover a myriad of topics, including: expediting green energy patents; initiatives to accelerate early-stage technologies from lab to market; academic licensing as a regional development catalyst; models for monetizing patents; valuation at the early stage and beyond; prior use and licensing post America Invents Act; risk-benefit issues associated with proposals to address patent assertion entities (PAEs); portfolio management and valuation in the post-Prometheus, Myriad and Bilski world, and more.

The meeting will also feature:

  • David Kappos, Partner, Cravath, Swaine and Moore LLP and Former Undersecretary of Commerce for IP & Director of the United States Patent & Trademark Office, who will share insights and perspective on emerging issues impacting IP.
  • Mock Mediation organized and presented by the World Intellectual Property Organization with LES President Russell E. Levine (who is on the WIPO's list of mediators and arbitrators) as the mock mediator.
  • District Court Judges Panel: Judicial Insight into Patent Infringement Litigation, featuring Judge Holderman (N.D. Illinois), as well as Judge McMahon (S.D. New York). The panel will be moderated by New York Intellectual Property Law Association (NYIPLA) President Charles Hoffman.
  • LES Foundation 2014 International Graduate Student Business Plan Competition Finals, March 24th from 1-5 p.m., an open forum where student finalists will present their innovative IP-based start-ups to a world-class panel of judges in hopes of winning valuable cash and in-kind prizes.
