Impact of Recent Court Cases on “Real World” Royalty Rates
Recent court decisions have generally reduced awards of reasonable royalty damages in patent litigations. These recent decisions address topics such as what is patentable subject matter, when injunctions should be issued, when attorney fees can be recovered and how royalty bases used in royalty calculations should be determined. How and to what extent have (or should have) these decisions impacted royalty rates negotiated in the “real world”? Come network with your fellow licensing professionals and hear a distinguished panel of experts discuss this important question from a variety of perspectives including litigation, transaction and industry licensing.
