This presentation is intended for attorneys, licensing professionals and business people who deal with the licensing of intellectual property periodically or on a regular basis. The purpose is identify provisions, unique to intellectual property, that can have unexpected consequences if not handled with the insight of the applicable statutes and case law. The topics will be focused on patent rights but also touch on copyright, software, trade secrets and trademarks. After providing a refresher on the statutes and contract construction, the presentation will address the key provisions of the typical license agreement, providing case law summaries for thorny issues and strategic commentary for drafting techniques and clauses.
