The Role of Intellectual Property in Unicorn Valuations: Insights from Silicon Valley  

It seems that not a day goes by without a commentary about Unicorns, a Silicon Valley-coined term used to describe a startup (pre-exit) with a valuation exceeding $1 billion. The number of Unicorns has recently crossed the 150 mark, and they have captured the attention of investors, analysts and other market observers who are trying to understand the factors driving the formidable valuations commanded by these ventures. A recent study conducted by Foresight Valuation Group explored the relationship between patent positions and Unicorn valuations. The study reveals that 30% of US Unicorns have no US patent assets (issued or pending), and about 62% of US Unicorns have only 10 or less US patents assets; these companies account for more than $157 billion in collective valuation and $25 billion in combined funding.

Efrat Kasznik, Foresight's president and a co-author of the study, will discuss the study's key findings, while addressing the following issues:
• What are Unicorns, and why are they showing up in recent years?
• What are the key factors driving Unicorn valuations?
• Is there the IP "valuation gap" when it comes to Unicorns and other high-valuation startups?
• Should investors care about the risk faced by startups with weak patent positions?
• What can Unicorns do to strengthen their patent portfolios?

Efrat Kasznik is an intellectual property valuation and strategy expert, with over 20 years of experience assisting IP holders of all sizes and across industries with the management and commercialization of their innovation. Efrat is the president of Foresight Valuation Group, a Silicon-Valley based IP valuation, strategy, and start-up advisory firm. She is a Lecturer on IP Management at the Stanford Graduate School of Business (GSB), as well as a mentor at the Stanford Venture Studio startup incubator and a lecturer at the Stanford OTL iFarm program. Efrat is the Co-Chair of the Internet of Things (IoT) committee of the High Tech Sector (LES USA-Canada). She has been listed on the IAM 300 list of World Leading IP Strategists for four years in a row (2013 to 2016), and is a frequent author and conference speaker on topics related to IP strategy and valuation. Throughout her career, Efrat has also been a co-founder and CFO of several Silicon Valley startups, and she currently serves on the advisory boards of startups, accelerators and venture funds in the US, Europe and Israel
