SPEAKER BIOS
Cara Burns, Partner, Hicks, Mims, Kaplan & Burns
Ms. Burns is an attorney focusing on intellectual property, entertainment and general business matters. Ms. Burns has represented entities and individuals in litigation and transactions concerning a wide array of matters including those involving copyright, trademark, right of publicity/privacy, music, motion pictures, Internet, technology, unfair competition, trade secrets, and contract disputes, as well as counseled clients in the daily operations of their businesses.

Areas of Emphasis:

– Contract and General Business disputes, including all pretrial and trial matters, as well as mediations, arbitrations and talent agency matters.
– Transactional matters including those relating to the acquisition of an entity or specific assets, and those related to technology, Internet, music, and motion pictures, such as for web content distribution, merchandising, licensing, recording, music publishing, option/purchase, performer, writer, domain name, executive, and joint venture agreements.
– Copyright, Trademark, Trade Secret and other intellectual property litigation and transactional matters, including matters involving infringement, ownership, licensing, and royalties.
– Personally obtained throughout the United States nearly 200 temporary restraining orders, seizure orders, preliminary injunctions, and/or asset freeze orders related to intellectual property matters for technology, clothing, entertainers, and luxury goods licensors/owners, including for Live Nation Merchandising, F.E.A., Inc., Bravado International Merchandising Services, Inc., TSURT, Inc., Novell, Motorola, the Software Publisher’s Association (including the first computer bulletin board seizures); Giant Merchandising, Izod, Alfred Dunhill, Louis Vuitton, and Warner Bros.
– Right of Publicity/Privacy and First Amendment matters, including: parody, merchandising of celebrity names and likenesses; and sound-a-like.
– Operated as in-house counsel for technology and Internet clients, handling day to day business matters.

John Gerber, Supervisory Import Specialist, Electronics Center of Excellence and Expertise, Office of Field Operations, U.S. Customs and Border Protection
John Gerber started his career with U.S. Customs Service in early 2003 as the agency was just merging with U.S. Immigration Service to ultimately become U.S. Customs and Border Protection (CBP). He was hired as an Inspector and within a few years changed positions to become an Import Specialist. In that capacity he worked on several Commodity Specialist Teams (CST) within the Port of San Francisco covering goods such as wearing apparel, electronics as well as working on a team in a specialized enforcement role responsible for protecting Intellectual Property Rights (IPR) for all goods. He has collaborated with enforcement teams from other ports around the U.S. and has traveled overseas on behalf of CBP for the purposes of visiting various manufacturers associated with previous Free Trade Agreement/Special Trade Program claims. He currently is assigned to the IP Branch, Enforcement Division, within the Electronics Center of Excellence and Expertise in Long Beach, California. He manages a team of Import Specialists that are responsible for regional enforcement action related to IP infringement.

John Gerber holds a Bachelor Degree in Broadcast Communication Arts as well as a Master of Business Administration (Beta Gamma Sigma) with an emphasis in International Supply Chain Management from San Francisco State University.

Vince Leoni, Partner, Miller Kaplan Arase LLP
Vincent Leoni is a partner with Miller Kaplan Arase LLP in Los Angeles. He has over 28 years of experience performing entertainment consulting, royalty/contract compliance and profit participation examinations. Vincent performs these services on behalf of licensors, owners of intellectual property film studios, production companies, recording artists, music publishers, profit participants and software developers.

In addition to his work in the US, Vincent has traveled extensively throughout the world, performing a number of licensee exams on behalf of major trademark licensors in Asia, Europe and Australia. Vincent has provided litigation support services on behalf of profit participants and licensors, and on multiple occasions has analyzed income streams in order to determine damages and the appropriate share of profits, revenues and royalties due participants. He has also been called upon to serve as an expert witness testifying in the Superior Court of the State of California.

Kim Tanner, Manager, Trademark Enforcement Group, Miller Kaplan Arase LLP
Kim Tanner is a Manager in the Licensing and Royalty Compliance group at Miller Kaplan Arase LLP and has 15 years of experience in performing music, film, television and licensing royalty compliance inspections. In addition, she has 5 years of experience providing brand protection and enforcement services.

Kim supervises the Intellectual Property and Trademark Enforcement division, working closely with U.S. and international Customs agencies. She identifies illegally exploited goods for the firm’s clients by gaining an understanding of the trademark owners’ products and guidelines, and provides Customs with independent assessments. To assist in the identification of counterfeit goods, Kim has provided product identification training to educate customs officials and frontline inspectors on the proper use of brand owner trademarks and how to identify suspect goods. Kim has also participated and spoken about trademark enforcement issues during joint training exercises with the U.S. government’s CBP and ICE divisions.

Joanne Vliet, Director, Silicon Valley (San Jose) U.S. Export Assistance Center, U.S. Department of Commerce
Joanne Vliet is the Director of the U. S. Commercial Service’s Silicon Valley office, located in San Jose, California. Part of the U.S. Department of Commerce, International Trade Administration, the agency maintains a network of trade promotion and policy professionals located in over 70 countries and 100 U.S. locations. The Commercial Service promotes U.S. exports, especially among small and medium-sized enterprises; advances and protects U.S. commercial interests overseas; and attracts inward investment into the United States. In addition to directing the operations of the Silicon Valley office, Ms. Vliet also manages a diverse client portfolio in the following sectors: aviation/defense, scientific instruments, financial and other professional services, robotics, and safety/security equipment. Ms. Vliet is a Marshall Memorial Fellow, and a graduate of the University of Texas at Austin, having pursued advanced studies at the Chinese University of Hong Kong and Nanjing University in China.
