Infringement and Induced Infringement

Peter Bormann and Robert Minnes of PCKIP will provide (1) an overview and update on recent Canadian and US patent law and principles around indirect and induced infringement, including the effect of the 2014 Akamai decision of the US Supreme Court (which held there can be no liability for induced infringement when there has been no direct infringement) and (2) some tips and insight into the effect if this on contracting, licensing, and risk mitigation, particularly in respect of IP indemnity provisions.

Peter Bormann, Patent Agent, Lawyer, PCK

Peter embodies PCK’s culture of combining sophisticated industry experience with professional excellence. In industry, Peter founded his own start up, worked as an investment banker, researcher and spent several years as General Counsel for a major publicly traded technology company, spearheading several major acquisitions. In law, Peter spent several years practicing with one of Canada’s most respected IP boutiques, practising the core skills of originating patent and trademark prosecution and working on a multimillion dollar freedom to operate clearance involving hundreds of patents.

Peter’s core practice focuses on corporate structure and finance for technology companies, rounded out with counseling in the areas of IP strategy and freedom to operate. Peter brings this rounded perspective to his practice, combining MBA, Law, patent and trademark agency qualifications with broad industry experience. Amongst his peers, Peter stands out with his ability to deeply appreciate a client’s underlying technology and IP needs, while managing the full range of corporate issues from incorporation to shareholders agreements and corporate finance.

Robert Minnes, Lawyer, PCK
Robert is counsel to the firm and provides solicitor support to the firm and clients ranging from start-ups to established global enterprises on a broad range of areas including: legal and business planning; IP protection, licensing and enforcement; commercial agreements; general corporate and commercial matters; privacy and data protection; confidential information; legal risk management; legal project management; transaction preparation and support; negotiation strategy and support; dispute resolution and litigation management; due diligence; transaction and exit preparation; investigations and regulatory issues; human resources and employment issues.

Robert’s broad legal experience includes roles as a litigator at one of Canada’s largest law firms and general counsel of a global publicly-listed software company. He has also served in non-legal executive roles and understands the relationship between business priorities and legal matters.

Robert also offers the firm and our clients an understanding of legal outsourcing and legal cost management strategies and supports the firm’s core principle to deliver legal services in the most cost efficient way practical, including the effective use of technology, workflows, and project management tools to create cost and process efficiencies while enhancing professional quality standards.
