Program:

Patents have been under attack over the past five years. The post-grant challenges provided by the 2011 America Invents Act (AIA) have made it cheaper, faster and easier to challenge the validity of issued claims, and court-made law has reduced the scope of subject matter that can be patented. AIA also expanded protection for prior commercial use, even if secret, against subsequently issued patents reading on that use. These developments plus the Defend Trade Secrets Act of 2016, which provides a federal cause of action for misappropriation of broadly defined trade secrets, has led some innovators to turn from patents to trade secret protection as was prevalent in the 1970s. This presentation will look at how the balance has been altered between patent and trade secret protections, and will discuss how to protect trade secrets through contractual provisions.

Topics include:
- An overview of the different trade secret regimes;
- Deciding between seeking patent protection and maintaining intellectual property as a trade secret, including consideration of instances where both regimes may be employed;
- Ensuring that trade secrets are adequately protected; and
- Avoiding misappropriation of another’s trade secrets.

• We are about a 5-10 minute walk from the Kendall/MIT Red Line T station 
• There are a number of parking garages in Kendall Square, the closest parking garage is the Kendall Square South Garage located at 350 Kendall Street, Cambridge, MA (it is managed by Pilgrim Parking). There is not metered parking in the immediate vicinity of our building as there is road construction, there are metered spots in and around Kendall Square.
