DESCRIPTION
An insider’s perspective of the legal battle surrounding so-called “gene patents.” Ben will discuss various aspects of the current lawsuit, AMP et al. v. USPTO et al. (popularly styled ACLU v. Myriad), including the jurisdictional and patent-eligibility elements of the case as well his impressions of the recent Federal Circuit argument. He will also discuss the public policy objections voiced by gene patent opponents and will provide a counter-perspective.
