DESCRIPTION
A panel of leading authorities on patent licensing will review the most significant legal and market developments of 2011 affecting patent licensing strategy and practice for both licensees and licensors. The panel will consider questions relevant to every licensing professional, including: What strategies are sophisticated licensors and licensees employing in light of case law that is regarded by many as adverse to licensors, such as Quanta, MedImmune and SanDisk? How have changes in the law on damages affected patent licensing strategy and negotiations? What risks do licensors and licensees face in the event of a bankruptcy of the other party, and what are the strategies for addressing those risks, particularly following the recent decision in Qimonda? Will patent reform affect patent licensing strategy or practice?

Dana Hayter
Dana Hayter is the Director of Licensing & Patent Acquisitions for Intel Corporation. He leads the groups responsible for Intel's worldwide patent acquisition, sales, licensing and cross-licensing activities, as well as related analysis, client counseling and strategy. Before joining Intel in 2004, Dana worked as Of Counsel at two Bay Area law firms and as a Trial Attorney at the United States Department of Justice's Antitrust Division.
Mark S. Holmes
With over half a billion dollars in patent deals under his belt, Mark Holmes is the founder and CEO of PatentBridge LLC, a privately held technology development firm in Silicon Valley that specializes in bringing to market select patented technologies covering extraordinary software and Internet-related breakthroughs. Recently PatentBridge sold a single patent for more than $4,000,000. Mr. Holmes has advised such technology savvy entities as Visa, Sony, Applied Materials, University of California at Berkeley as well as many startups and was named to the IAM Strategy 250 – The World’s Leading IP Strategists. He is a registered patent attorney, holds an engineering degree from Brown, is a member of the Institute of Electrical and Electronics Engineers (IEEE), and wrote the book Patent Licensing: Strategy, Negotiation & Forms. He is a member of the Board of Editors, Intellectual Property Counselor, published by West Publishing.
Nader A. Mousavi
Nader A. Mousavi, the moderator for this panel, is a partner and co-head of Sullivan & Cromwell’s Intellectual Property Group. Mr. Mousavi advises clients on intellectual property and technology matters in high-stakes transactions, including licensing, mergers, acquisitions, spin-outs, joint ventures, collaborations, financings, outsourcing, monetization, R&D, manufacturing, supply and settlement arrangements. He has been recognized as one of the “Top 100 Lawyers in California” by the Daily Journal (2012), as a leading lawyer in America in IT and Outsourcing by Chambers USA (2008-2011), as one of “The World’s Leading Patent and Technology Licensing Lawyers” by IAM Magazine (2010, 2011), and as one of the top “40 under 40” business professionals by Silicon Valley/San Jose Business Journal (2007). In 2011, Mr. Mousavi advised on deals valued in excess of $100 billion, including AT&T’s pending acquisition of T-Mobile, Fiserv’s acquisition of CashEdge, ING Direct’s pending sale to Capital One, Intel’s patent cross license with NVIDIA, Pharmasset’s pending sale to Gilead Sciences, and Skype’s sale to Microsoft. Mr. Mousavi began his career at TCS, an early-stage telecommunications software company, where he led strategy and legal affairs as TCS pioneered the “softswitch” and ultimately was acquired by a leading broadband equipment company. He later joined Hale and Dorr (now WilmerHale) in 2001, where he became a partner and co-founded the firm’s Palo Alto office before joining Sullivan & Cromwell. He holds a J.D. from Stanford Law School and a B.A. from UCLA.
Joseph Yang
Joseph Yang is a partner at PatentEsque Law Group, LLP, where he specializes in IP-centric deals (patent licensing/sales, technology transactions, JVs, and IP aspects of mergers & acquisitions) and in the use of IP as business assets. He has also been an arbitrator, overseen patent litigation, and led development of corporate patent portfolios. Joe previously served as VP & GC of Cryptography Research, Inc. (now part of Rambus Inc.), helping to develop and monetize a patent portfolio under which 5 billion chips a year are currently being produced by the company’s licensees. He has been named one of the “World’s Leading IP Strategists” and “World’s Leading IP & Technology Licensing Lawyers” by Intellectual Asset Management magazine, and is profiled in “Marquis Who’s Who in American Law.” Joe co-chairs the “Advanced Licensing” and “Advanced Patent Licensing” courses at the Practising Law Institute. He has also been cited by U.S. federal courts and treatises, on patent and licensing law, and has co-taught the “Patent Law and Policy” course at U.C. Berkeley School of Law. Before PatentEsque Law Group, Joe co-founded and later led the IP Strategy & Transactions practice in the Palo Alto office of Skadden, Arps, Slate, Meagher & Flom LLP. In his early career, Joe was a research engineer in the aerospace and energy industries. He holds a J.D. from Stanford and a Ph.D. (engineering) from the California Institute of Technology.
